1. Who you are contracting with

Tennis Error Management™ (the "Service") is provided by Elite Team Headquarters LLC("we", "us", "our"). By creating an account or using the Service you ("you", "the user") agree to these Terms & Conditions.

2. Acceptance of terms

By continuing to access or use the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization (a tennis club, academy, or team), you confirm that you have authority to bind that organization. If you do not agree, do not use the Service.

3. The Service

The Service is a courtside data tool that lets coaches log errors during tennis matches and generates reports, heat maps, and training recommendations. It is provided for informational and coaching purposes only and does not constitute medical, sports-medicine, or professional advice.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• Use the Service for any unlawful, fraudulent, or deceptive purpose;
• Infringe the intellectual property, privacy, or other rights of any third party;
• Probe, scan, scrape, or test the vulnerability of the Service, or attempt to circumvent any security or access control;
• Upload or transmit malware, viruses, or other harmful code;
• Resell, sublicense, or redistribute the Service or any portion of it without our written permission;
• Reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by law.

5. Accounts and credentials

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

We retain all right, title, and interest in and to the Service, including the software, documentation, visual design, reports, branding, and any improvements. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal coaching activities during your paid subscription. You retain ownership of the match data you enter; you grant us a limited license to host and process that data solely to provide the Service.

7. Payment, subscriptions, billing and refunds

Subscriptions are billed monthly in advance at the price shown on our pricing page. Plans renew automatically each billing period unless cancelled before the renewal date. You can cancel at any time; your subscription will remain active until the end of the current paid period. Refunds are handled in accordance with our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all payments, billing, sales tax / VAT, invoicing, refunds, and billing-related customer service inquiries. 8. Service availability

We work hard to keep the Service available and reliable but do not guarantee that it will be uninterrupted, error-free, or available at all times. We may suspend, withdraw, or modify all or part of the Service for maintenance, security, or operational reasons.

9. Suspension and termination

We may suspend or terminate your access to the Service if:

• You materially breach these Terms;
• Your account is overdue or payment fails after reasonable retries;
• We reasonably believe your use poses a security, fraud, or legal risk; or
• You repeatedly or seriously violate our acceptable-use policy.

You may terminate your subscription at any time from the Service or by contacting us. On termination, your right to use the Service ends; you may export your data for a reasonable period before deletion.

10. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your match data, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State in which Elite Team Headquarters LLC is registered, without regard to its conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where applicable law gives consumers the right to their local courts.
